2. Data Protection Officer
We have not appointed a data protection officer, as the legal requirements for doing so are not currently met. If you have any questions regarding data protection, please contact the controller named under section 1.
3. Competent Supervisory Authority
Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen (LDI NRW), Kavalleriestraße 2–4, 40213 Düsseldorf.
4. Scope of this Privacy Policy
kinetai.fit is currently under construction. Registration for the training service or signing in is not possible; no user accounts can be created, and no health, training, or account data is processed. However, you can voluntarily sign up for the beta waiting list (section 7); in doing so we process your e-mail address. Beyond that, only the technical access data described below is collected. As soon as registration- and account-related features are activated, this privacy policy will be expanded accordingly in advance.
5. Data Collected Automatically When Visiting the Website (Server Log Files)
When this website is accessed, data is automatically collected by the web server and stored in so-called server log files. These are:
- the IP address of the accessing device,
- the date and time of access,
- the specific page/file requested,
- the previously visited page (referrer), if transmitted,
- the browser type and version used,
- the operating system used,
- the transmitted language setting.
Purpose: technical provision, stability, and security of the website (e.g. defense against attacks).
Legal basis: Art. 6 Abs. 1 lit. f DSGVO (legitimate interest in the technically error-free and secure provision of the website).
Storage period: The log files are stored for a maximum of 14 days and are then automatically deleted.
6. Contacting Us
If you contact us by e-mail (info@kinetai.fit), we process the data you transmit (e-mail address, name, and the content of your inquiry) solely for the purpose of handling your request.
Legal basis: Art. 6 Abs. 1 lit. f DSGVO (legitimate interest in responding to your inquiry) or Art. 6 Abs. 1 lit. b DSGVO, where your inquiry is aimed at concluding a contract. We store this data only for as long as is necessary to handle the request, provided no statutory retention obligations apply.
7. Beta Waiting List / Newsletter Sign-up
On the home page you can voluntarily sign up for a waiting list in order to be informed about the launch of the beta phase of kinetai.fit. In doing so we process:
- your e-mail address,
- your chosen language setting,
- the IP address at the time of sign-up as well as the time of your consent (to provide proof of consent and to prevent misuse).
Purpose: inclusion in an interested-parties/newsletter distribution list, in order to inform you about the launch of the beta at your request.
Legal basis: Art. 6 Abs. 1 lit. a DSGVO (consent).
Double opt-in: After signing up, you will receive an e-mail with a confirmation link. Only after this link has been clicked does your sign-up take effect and is your address added to the distribution list. This serves to provide proof of your consent and to protect against third-party addresses being registered without their involvement.
Recipients: The management of the distribution list and the sending of the distribution e-mails are carried out via our own infrastructure, hosted by Hetzner Online GmbH (sections 8 and 9). Your e-mail address is not passed on to third parties.
Withdrawal and deletion: You can withdraw your consent at any time with effect for the future and unsubscribe from the distribution list — via the unsubscribe link in the distribution e-mails or by an informal message to the contact details named in section 1. We will then delete your data from the distribution list.
Storage period: until your withdrawal, at the latest until the end of the beta introduction phase.
8. Hosting (Processor)
This website is hosted by Hetzner Online GmbH, Industriestraße 25, 91710 Gunzenhausen, Deutschland, in data centers within the European Union. Hetzner processes the data named under section 5 exclusively on our behalf and in accordance with our instructions. For this purpose, a data processing agreement exists pursuant to Art. 28 DSGVO; the technical and organizational measures pursuant to Art. 32 DSGVO are part of this agreement.
9. E-mail Dispatch
The technical dispatch of e-mails (e.g. confirmation and distribution e-mails of the beta waiting list as well as replies to inquiries) is carried out via a mail server operated by ourselves on the infrastructure named under section 8, hosted by Hetzner Online GmbH within the European Union. A separate e-mail dispatch service provider is not used; no transfer of your e-mail address to third parties or to a third country takes place in this context. When an e-mail is delivered to you, a technically required transmission to the mail server of your respective e-mail provider takes place.
10. Cookies
This website does not set any consent-requiring cookies and does not integrate any third-party analytics or tracking tools. Only technically necessary data is processed as part of the delivery described under section 5. A cookie consent banner is therefore not required.
11. Your Rights as a Data Subject
Under the GDPR (DSGVO) you have the right to:
- access to the data processed about you (Art. 15),
- rectification of inaccurate data (Art. 16),
- erasure (Art. 17),
- restriction of processing (Art. 18),
- data portability (Art. 20),
- object to processing based on Art. 6 Abs. 1 lit. f DSGVO (Art. 21).
Insofar as processing is based on consent, you can withdraw it at any time with effect for the future. You also have the right to lodge a complaint with a supervisory authority (section 3).
To exercise your rights, an informal message to the contact details named under section 1 is sufficient.
12. Changes to this Privacy Policy
We reserve the right to amend this privacy policy in order to adapt it to changed features of the website or a changed legal situation. With the activation of account and training features, it will in particular be expanded to cover the processing then taking place (user accounts, health and training data, connected third-party services).
